Senator Carmichael moves to amend the bill on pages thirty-six and thirty-seven, section eight, lines twenty-nine through forty-two, after the word “years.” by striking out the remainder of the subsection and inserting in lieu the following: “If a majority has voted “yes,” another election on the issue shall not be held for a period of five years and that election shall be by state-wide option election. A statewide option election may thereafter be held if a written petition of qualified voters residing within the state equal to at least five percent of the number of persons who were registered to vote in the state in the next preceding general election is received by the West Virginia Secretary of State. The petition may be in any number of counterparts.

Petition for Statewide Option Election

We, the undersigned legally qualified voters, resident within the State of West Virginia, do hereby petition that the following question be placed on the ballot at the next state-wide primary or general election: Shall West Virginia Lottery Commission video lottery games be permitted within an area at the [name of racetrack] in which pari-mutuel betting is authorized by law?

And,

On page fifty-five, section seven, lines thirty-four through forty-nine, by striking out all of subsection (g) and inserting in lieu thereof a new subsection, designated subsection (g), to read as follows:

“(g) If the majority votes for allowing West Virginia Lottery table games at a licensed racetrack facility in a county, another election on the issue shall not be held for a period of five years and that election shall be by statewide option election. A statewide option election may thereafter be held if a written petition of qualified voters residing within the state equal to at least five percent of the number of persons who were registered to vote in the state in the next preceding general election is received by the West Virginia Secretary of State. The petition may be in any number of counterparts.
